These Terms of Use constitute a legally binding agreement between you and Creative Flair Arts Limited, trading as Creative Flair (“Creative Flair”, “we”, “us”, or “our”), regarding your access to and use of https://creativeflair.org and any related media, channels, or applications (the “Site”). We are a company registered in the United Kingdom with our registered office at Pinfold Barn, Southfield Lane, Burnley, Lancashire, United Kingdom.
By accessing or using the Site you confirm that you have read, understood, and agree to be bound by these Terms of Use. If you do not agree, you must stop using the Site.
We may update these Terms from time to time. We will indicate updates by changing the “Last updated” date above. Your continued use of the Site after updates constitutes acceptance of the revised Terms.
The Site may not be appropriate or lawful in all jurisdictions. If you access the Site from outside the United Kingdom, you do so at your own risk and are responsible for compliance with local laws.
The Site is intended for users aged 13 and over. If you are under 18, you must have consent and supervision from a parent or legal guardian.
Unless otherwise indicated, the Site, its design, software, databases, functionality, audio, video, text, photographs, graphics and other materials we create (collectively, Site Materials) and our trademarks, service marks, and logos (Marks) are owned or licensed by us and are protected by applicable intellectual property laws. Site Materials are provided “as is” for your information and personal use only.
Except as expressly permitted in these Terms, you may not copy, reproduce, distribute, publicly display, sell, licence, or otherwise exploit Site Materials without our prior written consent.
Subject to your compliance with these Terms, we grant you a limited, revocable, non-exclusive, non-transferable licence to access and use the Site and to download or print portions of Site Materials solely for your personal, non-commercial use.
Important: Section 2 covers Creative Flair’s own Site Materials. It does not apply to artist content you upload (defined and governed by Sections 6 and 7).
By using the Site, you represent and warrant that:
(1) all registration information you submit is true, accurate, current, and complete;
(2) you will maintain and promptly update such information;
(3) you have legal capacity and agree to these Terms;
(4) you are at least 13 years old;
(5) you will not access the Site via automated or non-human means;
(6) you will not use the Site for any unlawful purpose; and
(7) your use will comply with all applicable laws and regulations.
We may suspend or terminate your account if information you provide is inaccurate, incomplete, or in breach of these Terms.
You may need an account to use certain features. You are responsible for keeping your login credentials confidential and for all activity under your account.
Passwords: We will never ask you to disclose your password. Do not share it with anyone.
Payments: We do not collect, process, or store credit or debit card information. Payments on Creative Flair are handled by secure third-party payment processors (e.g., Stripe, PayPal) acting as independent controllers or processors. Their privacy and security terms apply to your transactions.
You agree not to:
The Site enables users to upload or post content (including artwork images and videos, text, profiles, posts, comments, and other materials) (“Contributions”).
Contributions may be visible to others. You are responsible for your Contributions and you must have all necessary rights to upload and share them.
You confirm that your Contributions:
We may, at our discretion, moderate, re-categorise, or remove Contributions that breach these Terms or applicable law, but we have no obligation to monitor.
You retain full ownership of your artwork and all intellectual property rights in your Contributions. Nothing in these Terms transfers copyright to us.
By uploading or posting Contributions to the Site, you grant Creative Flair a limited, non-exclusive, revocable, worldwide, royalty-free licence to host, store, reproduce, and display your Contributions solely for the purpose of operating, displaying, and promoting your specific pages or listings on the Creative Flair platform (including necessary technical copies, responsive resizing, caching, and distribution to end-users via our CDN). This licence ends when you remove the relevant Contribution from the Site, subject to reasonable technical retention and archival backups.
We will not use your artwork in off-site marketing, advertising, merchandising, or commercial campaigns without your prior explicit consent. Where you opt in, the scope and duration of any promotional licence will be set out clearly at the point of consent.
Creative Flair will not use your Contributions to train, fine-tune, or improve generative AI models. We also contractually prohibit our vendors and processors from using your Contributions for model training.
We will not sell, license, or share your artwork with third parties without your explicit consent, except where required by law or necessary to host and display your work on the Site (e.g., CDN, hosting providers, and security services under Section 24).
Nothing in these Terms is intended to waive your moral rights (including the right to be identified as the author and the right to object to derogatory treatment of your work) where applicable under UK law.
If you leave reviews or ratings, you must have firsthand experience and refrain from unlawful, discriminatory, or abusive content. We may remove reviews that breach these Terms.
You may link your account to third-party services where available. Those services’ terms apply. You can disconnect at any time. We are not responsible for third-party content or outages.
If you submit ideas, suggestions, or feedback about the Site itself (“Submissions”), you agree we may use them without obligation to you. This Section 10 does not apply to your Contributions or artwork, which are governed by Sections 6 and 7.
The Site may link to third-party sites and content. We do not control or endorse third-party content and are not responsible for it. You use third-party sites at your own risk.
Advertisers are responsible for their ads and compliance with applicable laws and rights. We provide ad space only and no other relationship is implied.
We may monitor and enforce these Terms, remove excessive files, and manage the Site to maintain proper operation and security.
We care about data privacy and security. Please review our Privacy Policy: https://creativeflair.org/privacy-policy. By using the Site, you consent to processing in the United Kingdom.
Payments: As noted in Section 4, we do not collect or store card details. Payment data is handled by Stripe, PayPal, or other processors under their terms and privacy notices.
Passwords: We do not request or store plain-text passwords. Account passwords are stored (if applicable) using industry-standard hashing. Never reuse your passwords across services.

We may forward your notice to the user who posted the material. Knowingly false notices may expose you to liability.
These Terms apply while you use the Site. We may suspend or terminate access at any time for breach or where required by law. You may close your account at any time.
Upon termination, licences granted to us under Section 7.2 end when your Contributions are removed or your account is closed, subject to reasonable technical retention and legal obligations.
We may change or discontinue the Site or any features at any time. We are not liable for downtime or service interruptions.
These Terms and any non-contractual obligations arising out of or in connection with them are governed by the laws of England and Wales. The courts of England and Wales shall have non-exclusive jurisdiction, and consumers may also bring claims in their country of residence where required by law.
Before starting legal proceedings, both parties agree to try to resolve disputes informally by emailing support@creativeflair.org. If we cannot resolve a dispute within 30 days, either party may proceed in court.
Information on the Site may contain errors or omissions. We may correct or update information without notice.
The Site is provided on an “as is” and “as available” basis, without warranties except as required by law. We do not guarantee uninterrupted or error-free service.
To the maximum extent permitted by law, we are not liable for indirect or consequential losses. Our aggregate liability for all claims relating to the Site shall not exceed the greater of £75 GBP or the amount you paid to us in the three months preceding the claim. Consumer law rights are not affected.
You agree to indemnify us against losses arising from: (1) your Contributions; (2) your use of the Site; (3) your breach of these Terms; or (4) your infringement of third-party rights.
We may store and process data to operate the Site. Although we back up data, you are responsible for your own backups. We use reputable hosting, caching, analytics, security, and payment providers as necessary processors or independent controllers. We contractually prohibit processors from using your artwork to train AI (see Section 7.4).
You consent to receive communications electronically and agree that electronic records and signatures satisfy legal requirements for written documents, to the extent permitted by law.

These Terms constitute the entire agreement between you and us concerning the Site. If any provision is unenforceable, the remainder remains in effect. No waiver operates as a continuing waiver. We may assign our rights and obligations at any time.

Our Services may link to third-party sites or apps we do not control. Their privacy practices apply to your use of those services. Review their policies before sharing data.
We use cookies, local storage, and similar technologies to operate the site (e.g., session management, security, load balancing) and—where permitted—analytics or marketing.

If you register or sign in using a social account, we receive the permitted profile data from that provider (e.g., name, email, profile picture). We use this information only for account creation/sign-in, subject to this notice. Your use of the social platform is governed by its own terms and privacy policy.
We keep personal data only as long as necessary for the purposes described, including to meet legal, accounting, or reporting requirements. When no longer needed, we will delete or anonymise data. Backups may persist for a limited period.
We use appropriate technical and organisational measures (access controls, encryption in transit, hardened infrastructure, monitoring, backups). However, no system is 100% secure. Transmitting personal data is at your own risk.

Accounts: You can update certain details in your profile. On request we can deactivate or delete your account, subject to legal retention obligations.
There is no universally accepted DNT standard. We do not currently respond to DNT signals. If standards emerge that we must follow, we will update this notice.
If you are a California resident, you may have rights under the CCPA/CPRA. We do not sell personal information. To exercise California rights, contact support@creativeflair.org. We will verify requests as required by law.
